Privacy Policy and Personal Data Processing Agreement
The product offered by international non-commercial (non-profit) legal entity Arbeiter-Samariter-Bund Georgia (hereinafter referred to as Project Implementer), created within the framework of the project “Stronger Together – Cooperative Action to Respond to Cross-border Emergencies between Georgia and Armenia”, funded by Directorate-General for European Civil Protection and Humanitarian Aid Operations (DG ECHO) (official website www.emtsd.com electronic content and/or software, which is currently available and may be added in the future) (hereinafter – the Project), can be used by any individual or legal entity (hereinafter – Beneficiary), who passes authorization on the official website of the Project Implementer www.emtsd.com fully agrees with and accepts the rules and conditions (hereinafter – Rules and Conditions) posted on the website www.emtsd.com including: Privacy Policy and Personal Data Processing.
By reading and accepting on the website of the Project Implementer hereby certify to have freely read and fully agreed with the Rules and Conditions published on the above-mentioned website www.emtsd.com
As the Beneficiary, I agreed to the Rules and Conditions posted on the website www.emtsd.com by clicking on the “I Agree” field when opening my personal account/page.
By signing on the website www.emtsd.com I unconditionally agree with the following:
1. Privacy Policy
Verbal, written or graphic information known and/or available to the Beneficiary within the framework of the specified relationships shall constitute “confidential information”.
The Beneficiary shall strictly protect confidentiality of the information and shall not disclose it directly or indirectly to third parties, unless in exceptional cases stipulated by the legislation of Georgia, of which the Beneficiary shall inform the Project Implementer in writing in advance.
The Beneficiary shall not disclose to third parties or publish information about services or other kinds of financial assistance provided by the Project Implementer within the framework of the Project without prior written consent of the Project Implementer. Such information is confidential and its disclosure constitutes a gross violation of the Rules and Conditions.
The obligations related to non-disclosure of confidential information shall apply during the term of the Project proposed by the Project Implementer to the Beneficiary, as well as after the completion or termination of the Project, regardless of the reason for termination.
The Beneficiary shall be responsible to the Project Implementer for intentionally or negligently violating the Rules and Conditions posted on the website www.emtsd.com.
2. Responsibility
A failure to fulfil or non-fulfillment of the obligations specified in Paragraphs 1 and 2 of the Rules and Conditions clause (together or separately), which may be caused by the Beneficiary’s intention or negligence, shall constitute a violation of the Rules and Conditions.Upon failure to fulfil the obligations specified in Paragraphs 1 and 2 of the Rules and Conditions (together or separately), the Project Implementer shall pay a fine in Georgian lari (GEL) equivalent to USD 2000 (two thousand) and shall redress in full the damage done by this failure.
